New Jersey Considering New Legislation on Workplace Injuries

February 11, 2021

The New Jersey State Senate passed a bill last month that would include parking lots as areas that would constitute workplace injuries. Introduced by Sen. Nicolas Scutari (D-Union), Senate Bill 771 would expand workers compensation claims to these designated lots and cover slips and falls, which are more prone to happen with inclement weather like snow and rain. This legislation would change a long-standing precedent that the arrival and departure from work locations does not fall under pursuable claims and cases rely more on specific evidence and circumstances. If passed by New Jersey, this could create a shift in consideration by state capitols and expand the scope of compensation claims elsewhere, especially in the Northeast where workers deal with similar weather. The Senate passed the legislation by a 22-10 vote and it awaits debate in the Assembly.
